Pay Up or Face Court! FKF Electoral Board Issues Legal Threat Over Unpaid Salaries

The Football Kenya Federation (FKF) Electoral Board has issued a seven-day ultimatum to FKF, demanding payment of outstanding dues totaling Ksh600,440 for services rendered during the 2024 FKF elections. The board, through its legal representatives, has warned that failure to settle the arrears within the stipulated timeframe will result in legal action against the federation.

This latest development intensifies tensions within the FKF administration, as the Electoral Board claims that despite successfully overseeing the election process, the federation has failed to honor its financial obligations.

FKF Electoral Board Demands Full Compensation

The FKF Electoral Board played a crucial role in ensuring a free and fair electoral process, which saw the ushering in of a new regime at the federation’s headquarters, Kandanda House. However, a demand notice sent to Football Kenya Federation Chief Executive Officer Patrick Korir reveals that board members have yet to receive their full compensation for their extended work.

In the letter, the board’s legal team emphasized the dedication and commitment of its members, who went above and beyond their contractual obligations to ensure the success of the elections.

“Our clients served the Federation as members of its Electoral Board Secretariat during the just concluded elections. In execution of the assignment, they dedicated their time, energy, skills, and expertise—sometimes working extended hours or even during holidays to deliver a free and fair election.”

Furthermore, the board noted that their mandate was extended until December 13, 2024, when the election process was officially concluded. Despite fulfilling their duties, the FKF has allegedly failed to pay the members in full.

Breakdown of Outstanding Payments

The demand notice details the unpaid amounts owed to each of the five board members:

  • Overtime Compensation: Each member was to receive Ksh8,307 for extra working hours, amounting to a total of Ksh44,417 per individual.
  • Holiday Pay: The board members worked during the October 10 public holiday, entitling them to an additional Ksh22,720 each.
  • Transport Allowance: They were entitled to a Ksh10,000 transport allowance per month but were only paid once, leaving arrears for the remaining months.

As a result, the total unpaid amount per member stands at Ksh120,088. With five members affected, the total sum Football Kenya Federation owes is Ksh600,440.

Legal Action Looms Over FKF

The FKF Electoral Board has accused the federation of deliberately withholding payments despite numerous follow-ups and requests for a resolution. The legal representatives of the board highlighted the lack of goodwill from FKF, describing its response as dismissive and uncooperative.

The letter reads:

“Despite our clients meticulously executing their mandate, resulting in a free and fair electoral exercise which ushered in the new regime at Kandanda House, you, on your part, have reneged on your obligation to pay them for services rendered.”

The board is now demanding immediate payment, including an additional debt collection charge of Ksh75,000, raising the total amount owed to Ksh675,440.

The notice further warns:

“We are therefore demanding immediate payment of the said sum of Ksh600,440, together with our debt collection charge of Ksh75,000, within seven days. Failure to do so, we shall institute legal proceedings against the Federation for the recovery of the same at your risk.”

If FKF fails to act within the given timeframe, it risks being embroiled in a court battle that could further tarnish its image and credibility.
